Former St. Petersburg Pharmacist Pleads Guilty to Prescription Fraud
Former St. Petersburg pharmacist Adam Nagy pleaded guilty earlier this month in a Tampa federal courtroom to conspiring to act outside the scope of his professional pharmacy practice by dispensing and distributing oxycodone. Nagy, who is only 30 years old, faces a maximum penalty of twenty years in federal prison. He also faces a possible fine and the forfeiture of any funds or other assets gained through the criminal venture.
According to the plea agreement filed in the case, from June 2008 through October 2008, Nagy worked as a pharmacist at a CVS Pharmacy in St. Petersburg, Florida. During that time, Nagy knowingly filled several fraudulent prescriptions for oxycodone and knowingly forged false prescriptions to obtain and dispense oxycodone.
As part of his plea agreement with federal prosecutors, Nagy has agreed to cooperate with the investigation and prosecution of other co-conspirators to the prescription fraud scheme.
It is important that those parties being investigated by authorities for their alleged participation in a crime contact experienced criminal defense attorneys very early in the process. If the government’s case appears to be strong, a defense attorney can often negotiate with prosecutors prior to the return of an indictment and/or arrest to minimize any potential sentencing exposure in return for a suspect’s cooperation with the investiation or prosecution. If the government’s case has weak spots, it is best to identify those as early as possible as well for strategic purposes.
